• 1.1This website/app is operated by Sakrat Infra — a unit of Sakrat Enterprise Private Limited (Bizotic Group), registered office: Howrah Trade Centre, Unit 1122, 11th Floor, Howrah Maidan, Howrah – 711101, West Bengal (“Company”, “we”).
• 1.2By using this platform, registering, filling an enquiry form, or merely viewing a listing, you (“User”) will be deemed to have agreed to these Terms and the Privacy Policy.
• 1.3If you do not agree with these Terms, please do not use this platform.
• 1.4Only persons aged 18 years or above who are competent to contract may use the platform.

• 2.1This platform is an intermediary for advertising, display, and exchange of information about land/property. The Company is not the owner, seller, or buyer of any land.
• 2.2All listing information, photos, area, boundaries, rate, and documents displayed here are provided by the respective landowner or broker. The Company does not guarantee their accuracy, completeness, or validity.
• 2.3The Company gives no warranty regarding the title, possession, mutation (dakhil-kharij), land revenue, or legal status of any land. Buyers are advised to have an independent legal check carried out by their own advocate before purchase.
• 2.4The Company is not a party to any sale agreement, earnest money (bayana), contract, or sale deed. All transactions take place directly between the buyer and seller, and the risk is entirely theirs.
• 2.5The Company gives no assurance of appreciation in the value of land, return, or investment profit.
• 2.6No content on the platform constitutes an offer for sale or investment advice — it is only an invitation to offer.

• 3.1All information provided at the time of registration must be true and up to date.
• 3.2You are responsible for the confidentiality of your account and password; every activity carried out from your account will be deemed to be yours.
• 3.3The Company may suspend or terminate an account without prior notice in the event of false information, misuse, or breach of these Terms.

The User shall not:

• Upload false, misleading, or forged information, documents, or photographs;
• List land that the User does not own, or for which the User is not authorised;
• Display disputed, sub-judice, mortgaged, government, unclassified (gairmajarua), or acquired land;
• Collect or scrape other users' contact details or use them for commercial purposes;
• Send unsolicited (spam) messages, calls, or promotions to anyone;
• Breach the security of the platform, introduce viruses, or reverse-engineer it;
• Publish obscene, defamatory, unlawful content, or content that infringes anyone's intellectual property;
• Violate any law relating to the sale of land — particularly RERA, stamp law, or the Prevention of Money Laundering Act.

• 5.1A User who uploads a listing represents that they hold a valid right to market the land in question and have the landowner's authorisation.
• 5.2The Company obtains a non-exclusive, royalty-free licence over content uploaded by the User for the purpose of displaying and promoting it.
• 5.3The Company has the right to reject, edit, or remove any listing without stating a reason.
• 5.4The Company may carry out quality checks on listings, but such checks shall not be treated as title verification or legal opinion.

• 6.1Any fee or revenue share payable by a broker/channel partner will be governed by a separate agreement executed with them.
• 6.2Making an enquiry is free for general visitors and prospective buyers.
• 6.3The Company does not take any earnest money, advance, or sale price from any user. If such a payment is demanded, please inform the Company immediately.
• 6.4Refund of fees already paid will be as per the terms of the relevant agreement; the setup fee is non-refundable.

• 7.1The platform's design, software, logo, brand, text, and creatives are the intellectual property of the Company.
• 7.2Copying, republishing, or commercial use of these is prohibited without written permission.

• 8.1The platform may contain links to third-party websites/services. The Company is not responsible for their content or policies.

• 9.1The platform is made available on an “As-Is” basis. There is no guarantee of uninterrupted or error-free operation.
• 9.2The Company shall not be liable for any loss, fraud, defect in documents, possession dispute, or any dispute between buyer and seller arising in any transaction.
• 9.3The Company's total liability shall, in any event, not exceed the amount actually paid by the concerned user to the Company in the preceding 3 months (if any).
• 9.4Under no circumstances shall the Company be liable for any indirect, incidental, or consequential damages.

• 10.1The User shall indemnify the Company against every claim, loss, and legal expense arising out of false information given by the User, content uploaded by the User, or breach of these Terms.

As per the Information Technology Rules, 2021:

Receipt of a complaint will be acknowledged within 24 hours, and an attempt will be made to resolve it within 15 days.

• 12.1The Company may amend these Terms at any time; the amended Terms will be effective from the date of publication on the platform.
• 12.2The Company may suspend or terminate a user's access without prior notice.
• 12.3These Terms shall be governed by Indian law, and the courts of to be completed shall have exclusive jurisdiction.
